This Privacy Policy explains how Feeling Yachty S.A., a holding company incorporated in the Republic of Panama (“Feeling Yachty,” “we,” “us,” “our”), collects, uses, discloses, and protects personal information when you visit or use https://www.feelingyachty.com (the “Site”) and any related forms, checkout flows, communications, or services offered through the Site (collectively, the “Services”).
By using the Site or Services, you acknowledge that you have read and understood this Privacy Policy.
1. WHO WE ARE
Our website address is: https://www.feelingyachty.com. Feeling Yachty S.A. operates as a holding company and brand/technology operator. Through the Site, we provide concierge coordination and lead-routing services that may connect users with independent third-party partners in our affiliated network (each, a “Network Partner”), such as yacht owners, charter operators, captains, crews, and other service providers (each, a “Charter Provider”), as well as payment processors/merchant services (each, a “Payment Partner”).
2. INFORMATION WE COLLECT
We may collect the following categories of information:
A) Information you provide directly
- Contact details: name, email address, phone number, messaging handles
- Inquiry/booking details: requested date/time, location, party size, preferences, itinerary, special requests
- Account/profile details (if available): username, profile info, preferences
- Communications: messages, emails, chat logs, call recordings where permitted, and customer support requests
- Content you submit: comments, reviews, photos, files, or other submissions
B) Information collected automatically
- Device and usage data: IP address, browser type, device identifiers, operating system, pages viewed, referring URLs, approximate location (e.g., city), timestamps
- Cookies and similar technologies (see Section 5)
C) Payment-related information
Payments may be processed by Payment Partners. We generally do not store full payment card numbers or sensitive payment authentication data on our servers. Payment Partners may collect and process payment details under their own privacy practices.
3. HOW WE USE INFORMATION
We use personal information to:
- Provide and operate the Site and Services
- Respond to inquiries and route requests to appropriate Network Partners/Charter Providers
- Coordinate bookings, logistics, confirmations, updates, and customer support
- Process (or facilitate processing of) payments through Payment Partners
- Personalize user experience and maintain preferences
- Send transactional messages (e.g., confirmations, service updates)
- Send promotional/marketing communications where permitted (with opt-out options)
- Detect, prevent, and investigate fraud, abuse, security incidents, and illegal activity
- Comply with legal obligations and enforce our terms

When visitors leave comments, we collect the data shown in the comments form, plus the visitor’s IP address and browser user agent string to help spam detection.
Gravatar: An anonymized string (hash) created from your email address may be provided to the Gravatar service to determine if you are using it. 7. MEDIA UPLOADS
If you upload images to the Site, avoid uploading images with embedded location data (EXIF GPS). Visitors may be able to download and extract location data from images you upload.
8. EMBEDDED CONTENT FROM OTHER WEBSITES
Pages on the Site may include embedded content (e.g., videos, images, articles). Embedded content from other websites behaves as if you visited that other website and may collect data, use cookies, embed third-party tracking, and monitor your interaction.

A) Network Partners / Charter Providers
If you request information, a quote, availability, or a booking, we may share relevant details with Network Partners/Charter Providers to provide services (e.g., your name, contact info, requested date/time, itinerary preferences, party size, and special requests).
B) Payment Partners
If you make or attempt a payment, payment-related data is processed by Payment Partners. We may share necessary identifiers and transaction details (e.g., amount, currency, booking reference) to facilitate payment and reconciliation. We do not control Payment Partners’ privacy practices.
C) Service providers
We may share information with vendors who help us operate our business (e.g., hosting, analytics, CRM, email/SMS delivery, customer support, spam detection), under appropriate confidentiality obligations.
D) Legal and safety
We may disclose information to comply with law, respond to lawful requests, enforce our agreements, protect our rights, investigate fraud/security issues, or protect users and the public.
E) Business transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to appropriate protections.
10. INTERNATIONAL DATA TRANSFERS
We are based in Panama. Your information may be processed in Panama and in other jurisdictions where our service providers, Network Partners, Charter Providers, or Payment Partners operate. These jurisdictions may have different data protection laws than your country.
By using the Site and submitting information, you understand that your information may be transferred and processed internationally.
11. DATA RETENTION
We retain personal information as long as reasonably necessary for the purposes described in this Policy, including to provide Services, maintain records, resolve disputes, enforce agreements, and comply with legal obligations.
- Comments: If you leave a comment, the comment and its metadata may be retained indefinitely unless you request deletion where permitted.
- Accounts (if applicable): Profile information is stored while the account is active and as needed afterward for legal/security reasons.
- Inquiries/bookings: Retained as needed for operations, support, accounting, fraud prevention, and legal compliance.
12. YOUR RIGHTS & CHOICES
Depending on your jurisdiction, you may have rights such as:
- Access: request a copy of personal data we hold about you
- Correction: request correction of inaccurate data

13. SMS / TEXT MESSAGING
If you opt in to SMS, we may send booking-related messages (confirmations, updates) and, where you consent, promotional messages.
- Message/data rates may apply. Frequency may vary.
- Opt out anytime by replying STOP.
- For help, reply HELP or email us.
SMS programs may be administered through third-party messaging providers. If you are outside the U.S., SMS delivery may be limited or unavailable. Your phone number and messaging data will be used in accordance with this Policy and our providers’ policies.
14. DATA SECURITY
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials and for accessing the Site using secure devices and networks.
15. CHILDREN’S PRIVACY
The Site and Services are not intended for children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will take appropriate steps.
16. GOVERNING LAW; EXCLUSIVE VENUE
This Privacy Policy is governed by the laws of the Republic of Panama. Any dispute, claim, or controversy arising out of or relating to this Privacy Policy or privacy/data practices shall be brought and resolved exclusively in Panama City, Republic of Panama, and the parties irrevocably submit to the exclusive jurisdiction and venue of the competent courts located in Panama City.
17. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy at any time. The “Effective Date” at the top indicates when it was last updated. Continued use of the Site after updates constitutes acceptance of the revised Privacy Policy.
